Terms of Service

MarketConnect provides procurement intelligence for capital construction programmes — tender execution, bid evaluation, vendor governance, and contract structuring — together with a client portal and AI-assisted tools. We may change, add, or withdraw features to improve or secure the Services.

The Services are for business and professional use. Portal access is by invitation from MarketConnect; there is no public sign-up. You are responsible for the activity under your account and for keeping your sign-in method — magic link, or sign-in with Microsoft or Google — secure. Tell us promptly at info@market-connect.net if you suspect unauthorised use.

When using the Services, you agree not to:

• Access, or attempt to access, accounts, data, or systems you are not authorised to use.
• Probe, scan, or test the vulnerability of the Services, or breach any security or authentication measure.
• Scrape, reverse-engineer, or copy the Services or their content except as permitted by law.
• Upload unlawful, infringing, or harmful content, or any malware.
• Misuse tender or bid information you access, or disclose it outside the process it belongs to.
• Interfere with the integrity or performance of the Services or with other users.

You keep ownership of the documents and data you submit through the Services. You grant MarketConnect a limited licence to host and process that material solely to provide the Services to you. You are responsible for having the rights to submit it and for its accuracy. Tender and bid information is confidential to the parties in that process and must be treated accordingly.

The Services, the website and its content, and MarketConnect’s methodology, workflows, scoring frameworks, and materials are owned by MarketConnect and protected by intellectual-property laws. Except for the access we grant you to use the Services, nothing here transfers any right in them. The MarketConnect name and logo are our trademarks and may not be used without our written permission.

Our agents and tools produce drafts and analysis to assist your team. They are decision-support, not a substitute for professional judgement: outputs require human review, and the decision — which vendor, which bid, which contract position — stays with you. We provide these outputs without warranty as to their accuracy, completeness, or fitness for a particular purpose.

The Services rely on and link to third-party services, including sign-in with Microsoft and Google and our hosting and email providers. Your use of those services is subject to their own terms and privacy policies, and we are not responsible for them.

To the fullest extent permitted by law, the Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied. We do not warrant that the Services will be uninterrupted or error-free, or that any procurement will achieve a particular commercial outcome.

To the fullest extent permitted by law, MarketConnect will not be liable for any indirect, incidental, special, or consequential loss, or for lost profits, revenue, or data. Nothing in these Terms limits liability that cannot be limited by law. Liability arising from a paid engagement is governed by the limitations in that engagement’s signed agreement.

You agree to indemnify MarketConnect against claims, losses, and expenses arising from your misuse of the Services, your breach of these Terms, or content you submit in breach of a third party’s rights.

We may suspend or end your access to the Services if you breach these Terms or to protect the Services, other users, or the integrity of a tender process. Provisions that by their nature should survive — including sections on your content, our intellectual property, disclaimers, liability, and governing law — continue after access ends.

These Terms are governed by the laws of the United Arab Emirates, and the courts of the United Arab Emirates have jurisdiction over any dispute, without prejudice to any mandatory rights you have under the law of your place of residence. A signed engagement agreement may specify a different governing law and forum for that engagement.

We may update these Terms from time to time. When we do, we will revise the “last updated” date above. Your continued use of the Services after a change means you accept the revised Terms.
